Pending Legislation Could Permanently Expand the Framework
While the extension preserves the current law for another four years, lawmakers continue to consider legislation that would make New York's independent practice framework permanent.
Companion bills S2360 and A1220 would eliminate the law's sunset provision altogether, allowing independent practice authority to remain in place without requiring future legislative extensions.2 The proposals would also establish an additional collaboration pathway for NPs who have not yet completed 3,600 hours of practice. Rather than requiring collaboration with a physician, eligible NPs below the experience threshold could collaborate with an experienced NP who has already qualified for independent practice.2
As of July 2026, neither bill has been enacted. Until additional legislation is approved, the existing framework remains unchanged.
